1. Acceptance of Terms

By accessing or using the Green Fenix website at greenfenix.org (the "Site"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the Site. Green Fenix is a registered 501(c)(3) nonprofit organization operating in California.

2. Use of the Site

You may use this Site for lawful purposes only. You agree not to:

- Use the Site in any way that violates applicable federal, state, or local laws or regulations

- Submit false, misleading, or fraudulent information through any form on the Site

- Attempt to gain unauthorized access to any portion of the Site or its related systems

- Use automated tools (bots, scrapers, crawlers) to extract content from the Site without our prior written consent

- Upload or transmit any malicious code, viruses, or harmful content

- Impersonate Green Fenix, its staff, partners, or any other person or entity

3. Eligibility for Programs

Green Fenix's tree planting program is available to eligible families rebuilding homes in fire-affected communities in California through our partnership with Habitat for Humanity. Submitting a "Request a Tree" form does not guarantee participation in the program. Eligibility is determined by Green Fenix and its partners at their sole discretion based on current program availability, geographic scope, and partnership criteria.

4. Donations

Donations made through this Site are processed by Squarespace Payments. All donations to Green Fenix are voluntary and, unless otherwise specified in writing, are non-refundable. Green Fenix is a 501(c)(3) tax-exempt organization; donations may be tax-deductible to the extent permitted by law. You should consult your tax advisor regarding deductibility.

Green Fenix does not store your complete payment card information. Payment processing is subject to Squarespace's Terms of Service and Privacy Policy, available at squarespace.com.

5. Intellectual Property

All content on this Site — including text, photographs, graphics, logos, and other materials — is owned by or licensed to Green Fenix and is protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written permission.

Limited personal, non-commercial use is permitted for informational purposes only, provided you do not remove any copyright or attribution notices.

6. Third-Party Links and Partners

The Site may contain links to third-party websites, including those of our partners (Habitat for Humanity San Fernando Valley, Moon Valley Nurseries, and others). These links are provided for convenience only. Green Fenix does not control and is not responsible for the content, privacy practices, or terms of any third-party site. Visiting linked sites is at your own risk.

When you submit information through our contact form or tree request form, you represent that all information provided is accurate and complete. Green Fenix uses submitted information as described in our Privacy Policy. We reserve the right to decline or remove any submission that violates these Terms or is otherwise inappropriate.

This Site is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. 9. Limitation of Liability

To the fullest extent permitted by law, Green Fenix, its directors, officers, employees, volunteers, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the Site, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from use of the Site shall not exceed $100.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms or use of the Site shall be resolved in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction in those courts.
